Hi,

As KBC kicks off on Star Plus today, let me start our own version of the same - KBG (Kaun Banega GD-Pati)!

Yes, an 'Online GD Contest' that could fetch you interesting prizes! This is just a way to take forward the initiative taken by Ronak!

Every two days, a topic will be given to you! You need to respond to the thread by giving your views on the topic...

Rules of the game:

1. You need to give your views only in bullet points, a maximum of 3 points and not exceeding 100 words in all (All bullets put together)!! The idea of an online GD is only to gather different perspectives and viewpoints on a particular topic and not display our communication skills! So, no long mails that no one would be interested in reading!

For example, if the topic is: "It's time we treat all Indian cricketers like Ganguly", your contribution may be:

(1) Carrot v/s Stick! McGregor's Theory X and Y of motivation! Theory X states that an authitarian style of Management (based on threat of punishment) will motivate employees.

(2) National pride at stake. No one can take his place in the team for granted.

(3) Regional quota based sytem of selection should change.

The point system is as follows:

1. You get 1 point for every 'original' idea that you contribute!

2. Repeatition of any idea (in the same form or some other form) will not fetch you any points. :(

3. If you repeat any point given by others (in the same form or some other form), you lose 1 mark. Hence it makes sense to respond as early as possible. You can refer to someone's point (in order to support or oppose him/her), but it should culminate into a fresh idea!

4. A killer - break through idea will fetch you 3 points!! :D

5. Data, Figures, Statistics, Examples, Analogies will fetch you 3 points (provided they are factually correct).

6. The points will be given only for your first contribution!! Any other contributions in the form of "Seeking Clarifications from others" or "Justifying your own view-point" will not fetch any points.

I will be the moderator, and will give points! I know, it is tough to give points in this (as it may get subjective), but never the less I will attempt the same. People questioning my decisions will face a two-topic ban :D

You will get 48 hours to contribute towards a topic! After 2 days, a new topic will be given. A round consists of 5 topics (i.e. 10 days). At the end of every round, winner will be announced (obviously the one who has scored maximum number of points).

No points will be given if you contribute to a particular topic after the deadline for that is over!

So, hum aur aap shuru karte hain "Kaun Banega GD-Pati"!

Round 1: 21-Jan to 31-Jan.
(The winner to this round will be declared on 31-Jan.)

The Grand Prize: Two tickets to 'Salaam-E-Ishq' (releasing this Friday!).

Topic 1 (Deadline to contribute: Wednesday 3.00 pm)

"The changing face of Indian Judiciary"

So, what are you waiting for? Shoot....kyonki "Kuch points zindagi badal sakte hain"

Topic : The Changing face of Indian Judiciary

Points :

A> Introduction : Judiciary System is the system of courts that manages law and justice for the State, Soverign and Country by panel of adjudgers (...Civil , High, Supreme Courts)

B> Judiciary system was brought in India thru British raj where it was used basically to suppress people instead of their welfare

C> After Independent Inda was established and its constitution drawn Judiciary system started working for the peoplewelfare

New KBC with only three Options ..... to inmese konsa point break-thru point hai ? ...... A , B ya fir C ? Kis option ko Freeze Kiya jaye ?

Take it further from here guys

Hi Ronak,

The person who starts the GD is at a disadvantage because of one of the two reasons:

1. Not getting to the crux of the problem (and speaking general stuff)

2.Danger of throwing all the cards upfront!

You have gone wrong, in the first point.

I think your start was very general! You have spoken about "Indian Judiciary System". But you have missed the big point "Changing Face"....Nowhere does it talk about the present scenario.

I'm afraid none of your points are path-beaking! Also, your points 2 & 3 convey the same ided "For whose welfare is it meant to be?".

So you get 2 points for this post! Also, since you have started, I will give you one opportunity to put one more point in your favour.

PS: The good thing is, you are already at 2-points. If you contiunue posting and others don't (as usual), you win! :)

Regards,

Manish sir

ha ha ha ha .....

Well i had to be general bcoz it was just 3 points given ..... may be a couple more wud have allowed me to streamline my thought ...but no probs i will try to manage it with one .... i think this proves path-breaking for 3 points in a shot.....

Point

D> the Changing Role came into picture after Independence but moreover we have seen it taking place in Recent times, from when the general Public has aroused for themselves and forced the Judicial system to think for them [eg . Anti-Reservation , Priyadarshani Matoo, Jessica Lal]

Hello Sir,

I really appreciate ur initiative for dis coz Ronak was really disappointed as there were no followers. I hope they vil enjot dis thread.

My points regarding dis topic are

1) Indian judiciary is known for its nonpartisanship, independence and justice
oriented approach. It has also tried to infuse advantegous skills to handle the
demanding or stimulating situation of Information and Communication Technology (ICT) but has not been achieved.

2) The increasing backlog of cases were reduced on great extent with the use of computerisation process in the Supreme Court and other courts. But, the backlog is still alarming because there shud be will and desire to dispose these assignment at faster speed. This is due to lack of training among Judges regarding use of Information Technology (IT).

3) Supreme Court of India has taken good initiative for the same. And we also need a public initiative as well. And the only solution for dis is “Electronic Courts in India” which is making a database of different situations that the Courts may face while discharging the judicial functions.

Regards,

Sheetal Bhosle :)

Adressing to Sheetal :

A> Public Initiative is rising. its the basic need that Judges need to be trained with a complete knowledge on e-courts with the entire case history put in the same dtabase so tht transfer of files is stopped and the case can be accessible to every Judge to make decisions

B> Yes the Computerization was brought in Supreme Courts .... but are those the only ones....why didnt this exceptional work by Judge A.M. Ahmedi cascaded further ?

C> The Police and Government records along with Court Cases need to be computerized so that for the judges, accessing information bcomes more aproachable and easier

i think the indian judicial system is changing and the foll things r the indications:
1) jessica lal case. matto case
2) speedy conviction on a rape accused ( of a german tourist)
3) mor death sen being given
4) mor n mor influence n opinion of sc in govmnt mttrs

in jessica lal n matoo case, u hav the judiciary payin heed to increasin public pressure n awardin strict punishmnt.......in matto case

SC is actuaaly running the country n doin good things, coz gov busy satisfyin vote bank....(resrevations n taintd ministers)

u find mor n mor court ruling on mattr which belong to gov....

good to see anupam here !

i agree thts it changing but did u notice these :

A> India stands among the top rankers in the number of pending Cases
B> The system here is a Bit rigid in not allowing SC in manipulation (i mean redesigning) of the Constitution as easily as available with other Countries

C> The faith of the General Public is decreasing a lot from thi kind of Judicial system and thus there is less enthusiasm from the public in helping the judicial system change as quickly as it likes to !

Hello everyone,

I agree with Ronak and I would like to state the following points,

(1) According to a recent article in Hindustan times, many cases are kept pending for as long as 10 years and even after they have been taken up, at times, it takes 5-6 years to resolve those. The article states the example of a couple who were married for 7 years but it took them 14 years to go through the divorce process, almost double the time.

(2) As a result the general public have lost faith in the judicial system and seem to be least eager to support any reforms let alone initiate any reforms.

(3) We can take the recent example of the prime suspect involved in the Nithari killings Mr.Maninder Singh Pandher being thrashed up outside the court. It just goes to show that people have indeed lost faith in the judicial system and have started taking laws in their own hands.

True tht things are changing ....agreed with your point Anupam ..... Theer are reforms .....

A>But are we thinking Pessimistically ?
Havent the System and its process have made us to think like this ?

B> I am still in favour tht there is a changing of the Face Value happening for the System but isnt it too slow enough ..... They Require a major revamp .....
I refocus my Question..... Why wasnt the Supreme Court Digitization casceded to High Courts and Civil Courts ? ...... It was a good process and it got us good results after it .... than why it took around 7 years to implement it in Other Courts (still not done).

C> There is a new issue coming up tht Abu Salem can fight Elections from the Jail itself. Isnt there a Step to be taken by the Judicial System to take charge here saying tht a Person with Criminal Offences shouldnt be Included in Public welfare until he finishes his imprisonment or the Charges are proved wrong ? Why is the Courts decision dont override some erronous Constitutional ammendements ?
